EagleView Privacy Policy

Eagle View Technologies, Inc. (“EagleView”, “we”, “us”, or “our”), recognize the importance of privacy. In this privacy policy (the “Privacy Policy”), we describe how we collect, use, and disclose information that we obtain about users of our websites on which we post this Privacy Policy (collectively, “Sites”) and online services (including access-controlled online services) accessible through such Sites (each, a “Service”) (the Sites and the Services to which this Privacy Policy applies being, collectively, the “Offerings”).

This Privacy Policy applies when you use the Offerings, and relates to any information that we collect from or about you, through such Offerings, from which you are personally identifiable. Your use of any Site and any Service, including any dispute over privacy related matters, is also subject to the applicable website terms of use (the “Site Terms”) and Service terms and conditions (the “Online Terms and Conditions”) for the respective Site and Service, including their applicable limitations on damages and the resolution of disputes. Additional or different privacy terms and policies may apply to the information we collect from customers that have entered into a written agreement with EagleView, signed by both parties, with respect to specific services; the terms in such signed, written agreement will control with respect to any conflicts with the Privacy Policy, Site Terms or Online Terms and Conditions.

Information We Collect

We collect information about you directly from you, from third parties, and automatically through your use of our Offerings. We may combine information collected from or about you from these various sources.

Information We Collect Directly From You. We collect information about you directly from you. The information we collect varies depending on your interaction with the Offerings. If you register to use our Offerings, we will collect your name, email address, password, phone number, company name, company industry and business segment, and company address. If you place an order with us, we will collect information to process your payment and request, being your name, payment card information, billing address, email address and delivery instructions. We will also collect other information in order to process your order and prepare requested reports, including site/property address, latitude/longitude and aerial images, which we associate with other data (such as other aerial images and structure measurements) that we create, compile or otherwise obtain and maintain as part of our databases and records) in order prepare reports for you. We collect information provided by you at our trade shows, being your name, email address, company name, telephone number and comments or opinions you may express and we may ask whether you are a member of a trade union, which we will treat as special category information.

We will also collect any other information that you provide to us through the Offerings, such as your name and the contents of your message(s) if you contact us through the Offerings, or your responses to survey questions.

Information We Collect from Third Parties. We collect information about you from the following third parties, Marketo, Inc., Zoom Information, Inc., LinkedIn, Facebook and Twitter, any publicly available information, and personal data relating to your name, email address, company name, telephone number and comment or opinion. We combine this information about you from third parties, with the other information we have collected in certain circumstances.

Information We Collect Automatically Through our Offerings. We automatically collect information about you through your use of the Offerings, being your IP address, the type of browser you are using, domain name, the website or application that led you to the Offerings, the website or application to which you go after leaving the Offerings, the dates and times you access the Offerings; the device you are using; operating system; device identifier; preferred language; and mobile network information. We may combine automatically collected information with other information that we collect about you. How We Use Your Information

We use your information, including personal information, for the following purposes:

  • Providing and Improving the Offerings. To provide and maintain the Offerings; to improve the Offerings; to tailor the information we display to you within the Offerings; to develop new features, products, or services; to authenticate users; to process payments; to fulfill orders and requests; to perform technical operations, such as updating software; to monitor and protect the security of the Offerings; and for other service- and support-related purposes. We will do so as is necessary for the performance of our contract with you, or as otherwise in our legitimate interests in operating and improving the Offerings.
  • Communications. To communicate with you (including by email) about your account and use of the Offerings, including to send you product or service updates and to respond to your inquiries. We will do so as is necessary for the performance of our contract with you.
  • Marketing. Where you have chosen to ‘opt-in’, we will provide you with news and newsletters, special offers, promotions, and other information we think may interest you, including information and promotional content related to third party products and services; and for other informational, marketing, or promotional purposes where you have provided us with an indication that you wish to receive such information.   • Research and Analytics. To analyze how users interact with the Offerings; to monitor and analyze usage and activity trends; and for other research, analytical, and statistical purposes. We will do so for our legitimate interests in operating the Site, so long as this does not outweigh your owns rights and interests.
  • Protecting Rights and Interests. To protect the safety, rights, property, or security of you, EagleView, the Offerings, or the general public; to detect, prevent or otherwise address fraud, security, or technical issues; to prevent or stop activity that EagleView, in its sole discretion, may consider to be, or to pose a risk of being, an illegal, unethical, or legally actionable activity; to use as evidence in litigation; and to enforce this Privacy Policy, the Site Terms and any applicable Online Terms and Conditions. We will do so for our legitimate interests in maintaining the security and legality of the Offerings, in the public interest, or in compliance with a legal obligation.
  • Legal Compliance. To comply with applicable legal or regulatory obligations, including as part of a judicial proceeding; to respond to a warrant, court order, or other legal process; or as part of an investigation or request, whether formal or informal, from law enforcement or a governmental authority.

How We Disclose Your Information

We disclose your information, including personal information, as described in this Privacy Policy or as described to you at the time of collection or disclosure, as follows:

  • Affiliates. We disclose your information to our affiliate, Pictometry International Corp. and we disclose your information to current or future affiliates or subsidiaries where necessary for database development, research, marketing, realizing business operation efficiencies and other purposes consistent with this Privacy Policy. Please see the Where We Send Your Information section for further details on any applicable cross-border transfers.
  • Vendors and Providers. We disclose your information to our vendors, service providers, agents, or others where necessary for them to perform functions on our behalf, or in order to provide the Offerings to you. If you order or use Offerings that require an onsite visit, these visits may be conducted by third party providers, in which case we would share your name, contact information and the order type with the third party provider. Similarly, we disclose your information to third-party service providers where necessary to process payments on our behalf, provide customer support, marketing services, or send you postal mail. Please see the Where We Send Your Information section for further details on any applicable cross-border transfers.
  • Business Transfers. We disclose your information to other entities where necessary in connection with and during negotiations of, an acquisition or merger, sale or transfer of our company, a business unit, or all or part of our assets, bankruptcy proceeding, or as part of any other similar business transfer.
  • Protecting Rights and Interests. We disclose your information where necessary to protect the safety, rights, property, or security of you, EagleView, the Offerings, any third party, or the general public; to detect, prevent, or otherwise address fraud, security, or technical issues; to prevent or stop activity which EagleView, in its sole discretion, may consider to be, or to pose a risk of being, an illegal, unethical, or legally actionable activity; to use as evidence in litigation; and to enforce this Privacy Policy, the Site Terms any applicable Online Terms and Conditions, and other agreements.
  • Legal Compliance. We share personal information with other people or organisations where we consider in good faith that one or more of the following circumstances apply:
    • (i) It is reasonably necessary to comply with any applicable law, regulation, legal process or enforceable government request;
    • (ii) Any applicable laws permit us to make the disclosure, where necessary in connection with any legal proceedings or prospective legal proceedings, or for the prevention or detection of crime;
    • (iii) It is necessary to establish, exercise or defend our legal rights (including providing information to others for the purposes of fraud prevention).
  • Aggregate and De-Identified Information. We disclose aggregate, anonymous, or de-identified information about users, from which you will no longer be identifiable, where required for marketing, advertising or research purposes.
  • With your consent. We share personal information with specific people or organisations where we have your consent in relation to those specific disclosures.

Where we send your information

Your personal data will be hosted in the U.S. and will therefore be transferred and stored outside of the European Economic Area (“EEA”) either on our system or of our subcontractors. Such third countries, including the U.S., may not offer the same level of data protection as your country of residence. Companies that we share your personal information with may also be located outside of the EEA. Where this is the case, we will ensure that appropriate or suitable safeguards are in place with such companies, such as the standard contractual clauses. Please let us know if you wish to obtain details of such safeguards.

Cookies and Other Tracking Mechanisms

We and our service providers use cookies and similar technologies (e.g., HTML5 local storage, clear GIFs) to track information about your use of the Offerings. We or our service providers combine this information with other information, including personal information, we collect about you. Where cookies are not necessary for us to provide the Offerings to you, we will ask for your consent to us storing and using cookies in accordance with this Privacy Policy, when you first visit the Sites. You may wish to consent to the use of cookies automatically through your browser settings, however you will have to do so, by ‘opting-in’.

Cookies. We or our service providers use cookies to track visitor activity on our Offerings and to enable targeted advertising or marketing based on your location or browsing habits. A cookie is a text file that a web site transfers to your computer’s hard drive so that the website can remember and identify it.  They contain anonymous information and will typically include the name of the domain from which the cookie has come; the “lifetime” of the cookie; and a value, usually a randomly generated unique number. They are widely used in order to make websites work, or work more efficiently, as well as to provide aggregate information to the owners of the site about their usage.  We or our service providers use cookies to track user activities on our Offerings, such as the pages visited and time spent on our Offerings.

Cookies can be set by the owner of the website itself (“first party cookies”) or by other websites that provide content (such as advertising) for the website that you are viewing (“third party cookies”). We do not control how third parties use their cookies, so we recommend that you check each of their cookie policies to see how they’re using them and how you can manage them.

How the Site uses Cookies

We send cookies which may be stored by your browser on your computer’s hard drive. We use that information to recognise your computer when you visit our Site, and to personalise our Site for you.

Some cookies used on the Site are temporary and remain on your device until you leave the Site, at which point they are deleted. These are often called session cookies. Session cookies are typically used on the Site to allow you to carry information across pages of the Site and avoid having to re-enter information, and to allow you to access stored information whilst you are logged into a user account on the Site.

Other cookies used on the Site remain on your device once you have left the Site (though how long will depend on the lifetime of the specific cookie). These are often called persistent cookies. Persistent cookies are typically used on the Site to help it recognise your device when you return to it, and to help us improve the structure of the Site by compiling anonymous, aggregated statistics that allow us to understand how users use the Site.

The cookies used by the Site can be grouped into three categories.

Strictly necessary cookies. These are cookies that are required for the operation of the Site. They allow our web servers to respond to your actions on the Site and whilst browsing it. The Site will not work for you without these cookies.

Analytical cookies. These cookies allow us to see how visitors move around the Site when they are using it. This helps us to improve the way the Site works, for example, by ensuring that users are finding what they are looking for easily, and also to analyse the effectiveness of our marketing campaigns.

Functionality cookies. These are used to recognise you when you return to the Site in order to remember your preferences, and also allow us to provide certain aspects of the Site’s functionality.

Clear GIFs, pixel tags, and other technologies. Clear GIFs are tiny graphics with a unique identifier, similar in function to cookies. In contrast to cookies, which are stored on your computer’s hard drive, clear GIFs are embedded invisibly on web pages. We use clear GIFs (also known as web beacons, web bugs or pixel tags), in connection with our Offerings to, among other things, track the activities of users of the Offerings, help us manage content, and compile usage statistics. We and our third party service providers also use clear GIFs in HTML emails to our customers, to help us track email response rates, identify when our emails are viewed, and track whether our emails are forwarded.

Interest-based Ads

We work with third parties, such Bing, DoubleClick, and Marketo, to serve advertisements on third-party websites or other media. This enables us and these third parties to display more relevant advertisements to you, based on your visits to our Sites and other websites. Third-party ad network providers, advertisers, sponsors and/or traffic measurement services use cookies, JavaScript, web beacons (including clear GIFs) and other tracking technologies to measure the effectiveness of their ads and to personalize advertising content to you. These third-party cookies and other technologies are governed by each third party’s specific privacy policy, not this one.

We provide these third-party advertisers with information, such as user email addresses and usage information, to assist us with displaying more relevant advertising. You can opt-out of many third-party ad networks, as explained below.

Opting out from one or more companies through the methods above will opt you out from those companies’ delivery of interest-based content or ads to you, but it does not mean you will no longer receive any advertising through our Site or on other websites. You may continue to receive advertisements, for example, based on the particular website that you are viewing (i.e., contextually based ads). Also, if you delete your cookies after opting out or if you are using a different device, your opt-out may not be effective.  Additional information is available on the above websites.

Third-Party Links

Our Sites may contain links to third-party websites and applications. Any access to and use of such linked websites and applications is not governed by this Privacy Policy but instead is governed by the privacy policies of those third parties. We are not responsible for the information practices of such third-party websites or applications.

Security

We have taken steps to help protect the personal information we collect. However, no data security measures can guarantee 100% security. You should take steps to protect against unauthorized access to your device and account by, among other things, choosing a robust password that nobody else knows or can easily guess and keeping your log-in and password private. We are not responsible for any lost, stolen, or compromised passwords or for any activity on your account via unauthorized password activity. We will not be liable for any loss of or interception of your information, unless this results from our failure to use reasonable steps to keep it secure.

Your Choices

Accessing, Modifying, or Deleting Your Personal Information. You can access, modify, or delete the personal information that you have provided to us by logging into your “MyEagleView” account page or emailing us at ukcustomerservice@eagleview.com with what you would like updated and we will respond to you promptly. Please note that we retain certain information about you as required by law, even after you have modified or deleted it.

Opting out of Email Communications from Us. Where you have previously ‘opted-in’, we will send periodic promotional and informational emails to you, about the Services and other products, services or information we think may interest you. You may opt-out of such communications by following the opt-out instructions contained in the email. Please note that it takes up to ten (10) business days for us to process opt-out requests. If you opt-out of receiving promotional and information emails from us, we will still send you emails about your account or any Services you have requested or received from us.

Right to Access. You have the right to access the information that we hold about you. We will respond to your request as soon as possible and (save for in certain circumstances) within one month. We will provide the requested information to you unless we consider your request to be manifestly unfounded or excessive, in which case we will discuss this further with you. We may need to verify your identity before providing your personal information to you.

Restricting our Use. You may request that we stop processing your personal information (other than storing it), if: (i) you contest the accuracy of it (unless the accuracy is verified); (ii) you believe the processing is against the law; (iii) you believe that we no longer need your information for the purposes for which it was collected, but you still need your personal information to establish or defend a legal claim; or (iv) you object to the processing, and we are verifying whether our legitimate grounds to process your personal information, override your own rights.

Object. You have the right to object to processing, including: (i) for direct marketing; (ii) for research or statistical purposes; or (iii) where processing is based on legitimate interests.

Portability. If you wish to transfer your information to another organization as data controller (and certain conditions are satisfied), you may ask us to do so, and we will send it directly if we have the technical means. We may need to verify your identity before transferring your information to another data controller.

Right to withdraw consent. If you previously gave us your consent (by a clear affirmative action) to allow us to process your personal information for a particular purpose, but you no longer wish to consent to us doing so, you can contact us to let us know that you withdraw that consent. If you do not do so, we will continue to rely upon that previous consent to keep using and processing your personal information in the same way.

Further information. You have a number of legal rights under English law in relation to how your personal information is used, and some of these are set out in this privacy notice. You can obtain further information about your rights from the Information Commissioner’s Office at www.ico.org.uk.

Storage

We will only keep your personal data for as long as we need to in order to fulfil the relevant purpose(s) it was collected for, as set out in this privacy notice, and for as long as we are required to keep it by law. For visitors to the Site, this period will be three years from the date of our last interaction with you.  For those with whom we have contractual obligations, this period will be seven years from the end of our contract with you. When such period ends, we no longer need your personal information or are no longer required to keep it by law, we will securely delete or destroy it.

Complaint

You also have the right to lodge a complaint in relation to this privacy notice with the Information Commissioner’s Office, or where you are resident in a jurisdiction other than England and Wales, with the relevant regulator in that jurisdiction. Children

Our Offerings are not targeted to children under thirteen (13) years of age and we do not knowingly collect personal information from children under 13. If we discover that a child under 13 has provided us with personal information, we will promptly notify the individual and delete such personal information from our systems.
